Guilt Not Good For A Defamation Lawsuit

A Marine staff sergeant has named John Murtha as a defendant in a defamation lawsuit over public comments Murtha made earlier this year.
Attorneys for Frank D. Wuterich, 26, argue in court papers that Murtha tarnished the Marine's reputation by telling news organizations in May that the Marine unit cracked after a roadside bomb killed one of its members and that the troops "killed innocent civilians in cold blood." Murtha also said repeatedly that the incident was covered up.
Unfortunately for the Wuterich, an NCIS investigation could quite possibly lead to charges being filed on him and the other Marines involved in the Haditha incident. I would guess defamation would be a wee bit harder to prove if in fact those charges are filed.
